Dear Mr. Arisaka:

This is in reply to your letter of June l0, 1988, describing a "flash to pass" headlighting feature and asking whether it is permissible under Federal Motor Vehicle Safety Standard No. l08.

Enclosed is a copy of the agency's letter of June 17, 1987, to MMC Services, Inc. commenting on a similar device. The fact that Stanley's passing beam would project through an amber lens rather than a clear, or noncolored one, does not affect this interpretation.
