NHTSA's Chief Counsel interprets the statutes that the agency administers and the standards and regulations that it issues. Members of the public may submit requests for interpretation, and the Chief Counsel will respond with a letter of interpretation. These interpretation letters look at the particular facts presented in the question and explain the agency’s opinion on how the law applies given those facts. These letters of interpretation are guidance documents. They do not have the force and effect of law and are not meant to bind the public in any way. They are intended only to provide information to the public regarding existing requirements under the law or agency policies.

An interpretation letter represents the opinion of the Chief Counsel based on the facts of individual cases at the time the letter was written. While these letters may be helpful in determining how the agency might answer a question that another person has if that question is similar to a previously considered question, do not assume that a prior interpretation will necessarily apply to your situation.

"Dear Mr. Kegg: This responds to your letter seeking an interpretatio of Federal Motor Vehicle Safety Standard No. 110, Tire Selection and Rims. You were uncertain about section S4.3.1's requirements related to the inflation pressure for spare tires specified on vehicle placards. You asked whether a vehicle manufacturer can specify a higher inflation pressure for a spare tire than the maximum inflation pressure molded on the tire's sidewall. As you know, FMVSS 110 sets forth requirements related to vehicle placards in passenger cars. Section S4.3 requires that the placard be 'permanently affixed to the glove compartment door or an equally accessible location' and display the vehicle capacity weight, the designated seating capacity, the vehicle manufacturer's recommended cold tire inflation pressure for maximum loaded weight and, subject to the limitations of S4.3.1, for any other manufacturer-specified vehicle loading condition, and the vehicle manufacturer's recommended tire size designation. FMVSS 110 does not have any provision requiring the inclusion of information on the placard related to spare tires or air pressure related to spare tires. Accordingly, a passenger car manufacturer may, but is not required to, specify information related to spare tires on the placard. In response to your question whether a passenger car manufacturer can specify a higher inflation pressure for a spare tire than the maximum inflation pressure molded on the spare tire's sidewall, section S4.3.1 of FMVSS 110 states that the vehicle placard must not specify an 'inflation pressure other than the maximum permissible inflation pressure' required to be molded on the tire itself by section S4.3 of FMVSS 109, New Pneumatic Tires, unless the alternative inflation pressure satisfies the three conditions set forth in S4.3.1. The first condition requires that the alternative inflation pressure be less than the maximum permissible inflation pressure. The second condition requires that the vehicle loading condition be specified for the alternative reduced pressure. The third condition requires that the tire load rating be specified by an individual manufacturer for the tire size at that inflation pressure that is not less than the vehicle load on the tire for that vehicle loading condition. Accordingly, a vehicle manufacturer could not specify on its placard an inflation pressure that exceeds the maximum permissible inflation pressure. I am enclosing a December 13, 1984 letter to Mr. Alberto Negro of Fiat, which explains the agency's position concerning a manufacturer's specification on the placard of an inflation pressure that exceeds the maximum inflation pressure molded on the tire. As that letter indicates, a manufacturer would have to meet each of the conditions specified in section S4.3.1, including that the alternative inflation pressure must be less than the maximum permissible inflation pressure. Because spare tires are subject to these requirements like any other pneumatic tire, a vehicle manufacturer could not specify a higher inflation pressure for a spare tire than the maximum inflation pressure molded on that tire. Dear Mr. Young: Thank you for your letter of October 13, 1983, concerning the potentia hazards posed to law enforcement officials by the use of opaque glass in automobiles. Through the exercise of its motor vehicle safety authority, the agency has addressed a part of this potential problem. However, given the limitations on the agency's authority, additional State action is needed to eliminate this potential problem.; Pursuant to the National Traffic and Motor Vehicle Safety Act, th agency has issued Federal Motor Vehicle Safety Standard No. 205, *Glazing Materials*, which specifies performance and location requirements for glazing used in vehicles. These requirements include specifications for minimum levels of light transmittance (70 percent in areas requisite for driving visibility, which includes all windows in passenger cars) and abrasion resistances. The specification for light transmittance precludes darkly-tinted windows in new automobiles.; In past interpretation letters, the agency has said that solar film an other materials used to make windows opaque are not glazing materials themselves and would not have to comply with Standard No. 205. However, installation of such films on new motor vehicles would be prohibited if the vehicle glazing no longer complied with the light transmittance of abrasion resistance requirements of the standard. If a manufacturer or a dealer places the film on glazing in a vehicle prior to the first sale of the vehicle, that manufacturer or dealer has to certify that the glazing continues to be in compliance with the requirements of Standard No. 205.; After a new vehicle has been sold to the consumer, he may alter th vehicle as he pleases, so long as he adheres to all State requirements. Under Federal law, the owner could install the tinting or other film on glazing in his vehicle whether or not the installation adversely affected the light transmittance and abrasion resistance of the glazing. Section 108(a)(2)(A) of the Vehicle Safety Act provides that no manufacturer, distributor, dealer or motor vehicle repair business shall knowingly render inoperative any device or element of design installed on or in a motor vehicle in compliance with an applicable motor vehicle safety standard. 'Render inoperative' means to remove, disconnect or degrade the performance of a system or element of design installed to comply with a Federal safety standard. Thus, none of those persons may knowingly install a tinting or other film on a vehicle for an owner if that action would render inoperative the light transmittance or abrasion resistance performance of the vehicle's glazing. Violation of the render inoperative provision can result in Federal civil penalties of up to $1,000 for each violation.; State law, rather than Federal law, governs the operational use o vehicles by their owners. Thus, it is up to the States to preclude owners from applying tinting or other films to their vehicle windows. A number of States have already adopted such laws. The agency would be glad to provide technical assistance on glazing requirements to the appropriate Missouri highway safety officials working on this problem.; I hope this explains the agency's authority to address the potentia problems posed by tinting and other films. Dear Mr. McConnell: Thank you for your letter of July 31, 1986, inquiring about the Federa safety standards that apply to roll-up window shades designed to be attached to a vehicle's window by suction cups. The following discussion explains how our safety standards apply to your products.; Some background information on how Federal motor vehicle safety law and regulations affect your product may be helpful. Our agency is authorized, under the National Traffic and Motor Vehicle Safety Act, to issue safety standards applicable to new motor vehicles and certain items of motor vehicle equipment. NHTSA, however, does not approve motor vehicles or motor vehicle equipment, nor do we endorse any commercial products. Instead the Vehicle Safety Act establishes a 'self-certification' process under which each manufacturer is responsible for certifying that its products meet all applicable safety standards. The agency periodically tests vehicles and equipment items for compliance with the standards, and also investigates other alleged safety-related defects. As explained below, installation of products in new and used vehicles would be affected by our regulations. In addition, any manufacturer of motor vehicle equipment is subject to the requirements of the Vehicle Safety Act concerning the recall and remedy of products with noncompliances or defects related to motor vehicle safety.; We have issued Federal Motor Vehicle Safety Standard No. 205, *Glazin Materials*, which specifies performance and location requirements for glazing used in vehicles. That section prohibits commercial businesses from tampering with safety equipment installed on a vehicle in compliance with our standards. Thus, no dealer, manufacturer, repair business or distributor can install a sun screen device for the owner of the vehicle, if the device would cause the window not to meet the requirements of Standard No. 205. Violation of the 'render inoperative' provision can result in Federal civil penalties of up to $1,000 for each violation.; Section 108(a)(2)(A) does not affect vehicle owners, who may themselve alter their vehicles as they please, so long as they adhere to all State requirements. Under Federal law, the owner may install sun screening devices regardless of whether the installation adversely affects the light transmittance. Individual States govern the operational use of vehicles by their owners and therefore it is within the authority of the States to preclude owners from using sun screens in their vehicles.; I am returning, under separate cover, the two samples you provided th agency. Dear Mr. Gebhardt: This is in response to your letter of November 30, 1981, in which yo raised several questions concerning the application of the exemption for dealer-to-dealer transfers of new cars. We are sorry for the delay in responding. Specifically you wanted to know if a dealer transferring a new vehicle with fifty miles registered on the odometer to another dealer was required to issue an odometer disclosure statement. You also requested that the agency provide you with cases subsequent to *Lair v. Lewis Service Center*, 428 F. Supp. 778 (D.Neb. 1977) which address the enforceability of the exemptions to Title IV of the Motor Vehicle Information and Cost Savings Act ('Act') (15 U.S.C. 1981 *et seq.*); Purchasers of motor vehicles rely heavily on the odometer reading as a index of the condition and value of the vehicle. The purpose of the Federal odometer laws is to establish certain safeguards against odometer tampering and to provide purchasers of motor vehicles an accurate statement of the mileage traveled by a motor vehicle. Section 408 of the Act requires that each transferor of a motor vehicle furnish to the transferee a written statement certifying the accuracy of the mileage. 15 U.S.C. 1988. The Odometer Disclosure Requirements specifically detail the information that must be disclosed. 49 CFR 580.4. However, the agency has determined that the exemption of certain transactions and vehicles is consistent with the purposes and scope of the Act. 49 CFR 580.5.; 49 CFR 580.5(b) exempts all transfers of a new vehicle prior to th first transfer to a customer who actually plans to use the vehicle from the Odometer Disclosure Requirements. The exemption applies to the dealer-to-dealer transfer of new vehicles regardless of the odometer reading. However, the exemption does not preclude a dealer from requiring the transferring dealer to certify the accuracy of the mileage.; The exemption is consistent with the purpose and scope of the Federa odometer laws. It is customary for dealers to transfer new vehicles to other dealers who plan to immediately resell the vehicle to a customer. Generally, the frequency of odometer fraud in these transactions is minimal. Indeed, prior to the transfer of a vehicle to a consumer, the odometer reading should only reflect the mileage accumulated while the vehicle is being demonstrated to a potential buyer or driven a short distance, which might be occasioned by a typical dealer-to-dealer transfer. We are unable to establish by issuing an opinion letter what the limit of such mileage incidental to the sale of a new car should be. If a dealer doubts the accuracy of the odometer reading, he can readily inspect the car for evidence of odometer tampering. In the absence of such evidence, the first dealer to sell the vehicle to a non-resale purchaser should be free to certify the mileage as accurate. The agency therefore views the issuance of odometer disclosure statements in such dealer-to-dealer transactions as unnecessarily burdensome on dealers.; In addition to *Lair v. Lewis Service Center*, the agency has knowledg of one other case *Romeri Trucking, Inc. v. Boise Kenworth Sale*, No. 80-1252 (D. Iowa, February 11, 1981), that addresses the issue of the enforceability of 49 CFR 580.5(a)(1). Dear Senator Hartke: Thank you for your letter of March 7, 1975, asking for detaile consideration of Mr. David L. Daugherty's concern that final-stage manufacturers will be unable to fulfill their certification responsibilities on air-braked trucks built after March 1, 1975. As you know, Standard No. 121, *Air brake systems*, became effective for trucks and buses on March 1, 1975.; Mr. Daugherty has raised one of the most critical aspects of truc manufacturing in assuring a minimum brake performance level. Unlike passenger cars, the vast majority of heavy trucks are manufactured by adding specialized bodies or equipment to a chassis-cab. These additions affect the center of gravity, dynamic load transferral, and other characteristics of the truck which determine in large part its stopping capability.; As a practical matter, meaningful dynamic brake performance standard cannot be developed without regulating the truck as it is completed and sold.; The National Highway Traffic Safety Administration (NHTSA) recognize that Standard No. 121, as the first comprehensive performance requirement for trucks, will limit somewhat the freedom of manufacturers to modify brake systems and mount bodies without regard for their effect on braking. We consider the increased care exercised by final-stage manufacturers to be one of the most significant benefits of the standard.; Mr. Daugherty correctly points out that chassis-cab manufacturer released the necessary information on their chassis only a short time before March 1, 1975. The two trade associations for final-stage manufacturers petitioned for delay of the standard for this reason. After careful consideration of possible relief, NHTSA denied those petitions. It was concluded that every form of relief had obvious drawbacks and would not achieve the objective of final-stage manufacturers to receive 121-type chassis to use in re-engineering their body and equipment installations. It was concluded that if the standard for completed vehicles were suspended, chassis manufacturers would no longer have to provide incomplete vehicles with the necessary equipment and final-stage manufacturers would be unable to develop solutions for their engineering problems. Even if incomplete vehicles could be certified and completed vehicles could be exempt, serious danger would exist when modifications of the new systems were undertaken without consideration of the handling consequences.; I would like to point out that the March 1, 1975, effective date doe not require an instantaneous ('one day') change for final-stage manufacturers. Part 568 of our regulations (49 CFR Part 568) permits a final-stage manufacturer to use the date of completion of the chassis as the date of certification of the completed vehicle. This means that the chassis manufactured prior to March 1 may be completed at any later period without meeting Standard No. 121. It is not until final-stage manufacturers begin to receive the chassis which have just started to be produced that they will have to complete vehicles in conformity with the standard. They now have data on the new chassis, and thus have a period in which to make modifications. Several manufacturers have large inventories of pre-121 chassis and it should be several months before all trucks will be completed in conformity with Standard No. 121.; Thank you for your continuing interest in motor vehicle safety. "Dear Ms. Salvio: This responds to your November 10, 1987, lette asking whether the 'Guardian Gate' your company manufactures for firefighting vehicles is subject to Safety Standard No. 206, Door Locks and Door Retention Components. The answer to your question is yes, if the Gate is installed on new vehicles and if the area into which the door leads contains one or more seating positions. The advertising material you enclosed states that the Guardian Gate 'is designed to help firefighters while they are riding to fires in the jump seat of apparatus sic .' The advertisement said that the unique feature of the Guardian Gate is its locking mechanism which enables the gate to be locked 'on both its sides to the vehicle, the cab side, as well as the pump panel side.' The advertisement said this 'dual locking' feature is intended to minimize the likelihood that the gate will be opened either unintentionally or because of 'hazardous conditions' (an explanation of which the advertisement did not include). Paragraph S4 of Standard No. 206 states: 'Components on any side door leading directly into a compartment that contains one or more seating accommodations shall conform to this standard. ...' (S4 exempts certain types of doors from Standard No. 206, but these are doors that are readily removable or that are not provided for retaining occupants. Since the Guardian Gate falls into neither of these two categories, the exemptions are not relevant to your inquiry.) From the information you provided in your letter and in telephone calls between you and Ms. Hom of my staff, we understand that the standing area on the firefighting vehicle enclosed by the Guardian Gate contains a jump seat. Because 'seating accommodations' referred to in S4 include jump seats, a Guardian Gate that is installed to enclose a jump seat area on a new firefighting vehicle must comply with Standard No. 206. This determination is consistent with an August 13, 1980 letter from NHTSA to Mr. L. Steenbock of the FWD Corporation (copy enclosed), in which this agency stated that a door leading to a standing area that contains no seating position would not have to comply with Standard No. 206. Because Standard No. 206 applies to passenger cars, multipurpose passenger vehicles and trucks (e.g., firefighting vehicles), and not to replacement parts for installation in used vehicles of these types, you may sell the Guardian Gate to vehicle owners without regard as to whether the Gate complies with the performance requirements of the standard. However, we urge you to consider meeting those requirements voluntarily, to ensure that the Gate will perform to specified levels for the safety of firefighters riding in the 'jump seat area' of the vehicle. You should also be aware that you are responsible under the National Traffic and Motor Vehicle Safety Act, as a manufacturer of motor vehicle equipment, to ensure that your product contains no defect relating to motor vehicle safety. If you or this agency determines that a safety related defect exists, you must notify purchasers of your product of the defect and remedy the problem free of charge. "Dear Mr. Kaizaki: This responds to your letter requesting a interpretation of Standard No. ll9, New Pneumatic Tires for Vehicles Other Than Passenger Cars. You asked whether it is permissible to place two tire size designations, 385/65R22.5 in larger letters and l5R22.5 in small letters, on the same tire. The answer to your question is no. By way of background information, the National Highway Traffic Safety Administration does not provide approvals of motor vehicles or motor vehicle equipment. Under the National Traffic and Motor Vehicle Safety Act, it is the responsibility of the manufacturer to ensure that its vehicles or equipment comply with applicable standards. The following represents our opinion based on the facts provided in your letter. The practice of labeling two tire sizes on one tire, as you requested in your letter, was once a fairly common practice and was referred to as 'dual-size markings.' Dual-size markings were a marketing effort by tire manufacturers to try to persuade consumers to change the size and/or type of tire on their vehicles, by representing that this particular tire size was an appropriate replacement for two different sizes of tires. However, the practice of using dual-size markings confused many consumers about the size of the tire on their vehicle. The only purpose of the Federally required markings on tires is to provide consumers, in a straightforward manner, with technical information necessary for the safe use and operation of the tire. The agency concluded that it was inappropriate to permit a marketing technique that was confusing many consumers to defeat the purpose of the required markings on tires. Accordingly, dual-size markings were expressly prohibited for passenger car tires subject to Standard No. 109, 36 FR 1195, January 26, 1971. The marking requirements for tires subject to Standard No. 119 are set forth in section S6.5 of the standard. Section S6.5(c) requires that each tire be marked on both sidewalls with 'the tire size designation as listed in the documents and publications designated in S5.1.' Section S5.1 of Standard No. 119 requires each tire manufacturer to ensure that a listing of the rims that may be used with each tire the manufacturer produces is available to the public. This may be done either by the individual manufacturer furnishing a document to each of its dealers, to this agency, and to any person upon request, or the manufacturer may rely on the tire and rim matching information published by certain standardization organizations. While Standard No. 119 does not expressly prohibit dual-size markings, section S6.5(c) uses the singular when it refers to the 'tire size designation' to be labeled on the tire. Considering the past history associated with dual-size markings, this agency interprets section S6.5(c) of Standard No. 119 as prohibiting a manufacturer from marking a tire with two different size designations, even if a document or publication designated in S5.1 were to show two different size designations for the same tire size. TITLE: FMVSS INTERPRETATION

TEXT: This is in response to your telephone conversations of July 13, 1979, with Mr. Steve Wood of my office, in which you requested a general explanation of the Federal law concerning auxiliary gasoline tanks and the conversion of gasoline-powered vehicles to propane-powered vehicles.

The following discussion sets forth the implications of these activities under the National Traffic and Motor Vehicle Safety Act of 1966, as amended. The discussion first looks at the Federal Motor Vehicle Safety Standard (FMVSS) applicable to fuel systems and then at the defect responsibilities that might be involved. Next, a brief mention is made of the possibility of product liability suits.

Before getting into the legalities of these installations and conversions, I want to stress my concern about the danger which these practices may pose to the occupants of vehicles which are altered and even to occupants of other vehicles. These practices may seriously increased the risk of fire if these altered vehicles are involved in accidents. Even where there are no legal liabilities, this threat to safety may be present.

The Act authorizes the National Highway Traffic Safety Administration (NHTSA) to issue FMVSS's applicable either to entire vehicles or to equipment for installation in vehicles. The only standard relevant to this discussion, FMVSS 301-75, is a vehicle standard. It applies to vehicles which use fuel with a boiling point above 32 degrees F. and which are (1) passenger cars, or (2) multipurpose passenger vehicles, trucks, or buses with a gross vehicle weight rating (GVWR) of 10,000 pounds or less or (3) schoolbuses with a GVWR greater than 10,000 pounds. If the need were found, a standard could also be issued for fuel systems designed for installation in new or used vehicles.

Under section 108(a)(1)(A) and (b)(1) of the Act, new motor vehicles must comply with the FMVSS's applicable to them until they are first purchased by someone for purposes other than resale. That purchase is completed when the vehicle is delivered to the ultimate consumer. The NHTSA regulations include two measures designed to ensure compliance with applicable FMVSS's until this delivery. First, manufacturers of new vehicles are required to affix to each vehicle they produce a lable which certifies the vehicle's compliance with all applicable FMVSS's. In addition, any person who prior to the first sale, alters a certified vehicle in a manner that significantly affects either its configuration or purpose is considered to be not only an alterer but also a manufacturer and therefore, must recertify the entire vehicle as complying with all applicable FMVSS's. (49 CFR 567.7 and Preamble to 37 F.R. 22800, October 25, 1972). The only alterations that a person may make prior to the first sale of a vehicle without being considered a manufacturer subject to the recertification requirements are minor finishing operations or the addition, substitution or removal of readily attachable components such as mirrors, tires, or rim assemblies. (49 CFR 567.7).

Should a noncompliance be discovered in a recertified vehicle, as a result of an alterer's modification, the alterer would be liable for a civil penalty unless he or she could establish that he or she did not have actual knowledge of the noncompliance, and that he or she did not have reason to know in the exercise of due care that the vehicle did not comply. (Section 108(b)(2) of the Act). The civil penalty imposed could be up to $ 1000 for each violation of an applicable FMVSS. (Section 109 of the Act).

With respect to FMVSS 301, the effect of the alterer provisions is that not only must the original gasoline fuel system meet the performance requirements encompassed by the standard but that any auxiliary or replacement tank added by an alterer must meet them also.

If the alterer converts the gasoline fuel system to a propane fuel system, the vehicle must still be recertified. However, FMVSS 301-75 would cease to be a factor since the standard would no longer apply to the vehicle. Propane has a boiling point below 32 degrees F. and FMVSS 301-75 applies only to vehicles using fuel with a higher boiling point. Finally, if the alterer converts a gasoline-powered vehicle so that it is both gasoline-powered and propane-powered, he must recertify the entire vehicle as complying with all applicable standards, including FMVSS 301-75.

After the first purchase of a vehicle for purposes other than resale, tampering with the vehicle is limited by section 108(a)(2)(A). That section in essence prohibits the entities and persons listed below from knowingly removing, disconnecting or reducing performance of equipment or elements of design installed on a vehicle in accordance with applicable FMVSS's. There is no prohibition against an individual person modifying his or her own vehicle. Specifically, the section provides:

No manufacturer, distributor, dealer or motor vehicle repair business shall knowingly render inoperative, in whole or part, any device or element of design installed on or in a motor vehicle or item of motor vehicle equipment in compliance with an applicable Federal motor vehicle safety standard . . .

A person or entity found to have violated this section would be liable for a civil penalty of up to $ 1000 for each violation. (Section 109 of the Act).

If a tamperer adds an auxiliary gasoline tank to a vehicle manufactured in accordance with FMVSS 301-75, and in the process knowingly reduces the performance of the fuel system originally installed in the motor vehicle, he or she has violated section 108(a)(2)(A). (H.R. No. 1191, 93d Cong., 2d Sess. 34 (1974). Such reduction of performance could occur, for example, if gasoline from the original system (a fuel system includes the filler pipe, tank, gasoline lines, fuel pump, carburetor, and engine) could be leaked through a rupture in the auxiliary tank and fuel lines, and if the design, materials, construction, installation or location of the auxiliary tank and fuel lines made them more susceptible to rupture than the original fuel system.

If a tamperer removes the original gasoline tank and installs a replacement one, section 108(a)(2)(A) is violated unless the performance (as defined by FMVSS 301-75) of the replacement tank equals or exceeds the performance of the original tank. To determine the relative performance of the replacement tank, a number of issues would have to be examined, including the quality of the replacement tank, the connection of the tank with the filler pipe and fuel lines to the fuel pump, and the location of the tank with respect to surrounding vehicle structures. For example, if unlike the original tank, the replacement tank were sufficiently near surrounding vehicle structures so that those structures might be pushed against or into the replacement tank and cause a rupture in a collision, the performance of the fuel system would have been impermissibly reduced.

There is no liability under section 108(a)(2)(A) in connection with FMVSS 301-75 if the tamperer converts a used gasoline-powered vehicle into a propane-powered vehicle. Modifying safety systems of a vehicle being converted from one vehicle type to another would not violate section 108(a)(2)(A) so long as the modified systems complied with the FMVSS's that would have been applicable to the vehicle had it been originally manufactured as the vehicle type to which it is being converted. For example, in converting a 1978 gasoline-powered car to a propane-powered car, the converter would not be governed by FMVSS 301-75 since that standard did not apply to 1978 propane-powered cars.

The case of a tamperer who modifies a used gasoline-powered vehicle so that it has a dual gasoline/propane system would be essentially the same as that of the person who adds an auxiliary gasoline tank. If the tamperer knowingly reduces the performance of the gasoline system in adding the propane system, he or she has violated section 108(a)(2)(A).

As to safety defect responsibilities under sections 151 et seq. of the Act, persons who alter new vehicles by installing auxiliary or replacement gas tanks or by converting a gasoline fuel system to a propane fuel system as well persons who produce the equipment being installed are fully subject to those responsibilities. Sections 151 et seq. provide that manufacturers of motor vehicles and motor vehicle equipment must notify owners of vehicles and equipment with safety-related defects and remedy those defects free of charge. As explained earlier the term "manufacturer" includes persons who alter new vehicles by doing more than simply adding, substituting, or removing readily attachable components or performing minor finishing operations. Since alterations involving installation of auxiliary replacement gas tanks or conversion of gasoline systems to propane systems are more substantial, persons who make those alterations are manufacturers.

Thus the alterer who installs auxiliary or replacement tanks or makes propane conversions is responsible for safety defects in the installation of the tanks and propane systems. Installation defects include defects in the method and location of installation.

Under 49 CFR Part 579, the auxiliary and replacement tanks and the propane systems would all be treated as "replacement equipment." Part 579 places the responsibility for safety defects in the performance, construction components, or materials, of replacement equipment on the manufacturer of such equipment. Therefore, the manufacturer who produces auxiliary or replacement tanks or propane systems, as distinct from the alterer who installs such equipment, would be subject to these responsibilities for production defects. A person who both produces such equipment and installs it in new vehicles prior to their delivery to the ultimate consumer would be subject to responsibilities for safety defects stemming from both production and installation of the equipment.

Under section 108(a)(1)(D) and 109(a), any person who fails to provide notification of or remedy for a safety defect is liable for a civil penalty of up to $ 1000 per violation.

Tamperers have no safety defect responsibilities for their tampering. As noted above, only manufacturers of motor vehicles or motor vehicle equipment are subject to sections 151 et seq. Since the term "manufacturer" is interpreted to refer to those who produce, assemble or import new vehicles or equipment and since tamperers, by definition, deal with used vehicles only, tamperers are not manufacturers.

Finally, there is the larger and more far reaching question of the liability of the alterers, tamperers, and manufacturers in tort. Whether or not these parties are liable under the Act for their actions, they may well be liable in tort. Both alterers and tamperers may be liable for the manner and location in which they install auxiliary or replacement gasoline tanks or propane systems in vehicles. Likewise, the manufacturers of these items of motor vehicle equipment may be liable for their design, materials, maufacture or performance. These persons may wish to consult a local lawyer on their liability in tort.

Dear Mr. Rios:

This responds to your letter of June 29, 1995, to Marvin Shaw of this office requesting information on obtaining a certification from the U.S. that the wheels you supply to automobile manufacturers in Mexico comply with Federal Motor Vehicle Safety Standard (FMVSS) Nos. 110 and 120.

You explained in your letter and in telephone conversations with Walter Myers of this office that your company supplies steel and aluminum passenger car wheels to automobile manufacturers located in Mexico. You stated that Nissan Mexicana requires from you a certificate demonstrating compliance with FMVSS Nos. 110, Tire Selection and Rims, and 120, Tire Selection and Rims for Motor Vehicles Other Than Passenger Cars. Your letter asked how to obtain such a certification and for information on other responsible U.S. government agencies and approved test labs.

On July 21, Mr. Myers telefaxed you copies of two interpretative letters previously issued by this office, one to Mr. Ralph Trimarchi dated February 11, 1985, and one to Mr. Jay D. Zeiler dated November 20, 1977. We explained in those letters that U.S. law requires motor vehicle and equipment manufacturers to self-certify their products and that the U.S. government does not test or certify products prior to first retail sale. Rather, this agency, the National Highway Traffic Safety Administration (NHTSA), randomly tests vehicles and equipment for compliance with the FMVSSs. Mr. Myers also telefaxed you copies of FMVSS Nos. 110 and 120 on July 24, 1995.

We would like to advise you of another issue. 49 Code of Federal Regulations (CFR) Part 566 (copy enclosed) requires manufacturers of motor vehicle equipment to which an FMVSS

applies (referred to in the regulation as "covered equipment," such as wheels) to submit its name, address, and a brief description of the items of equipment it manufactures to NHTSA. NHTSA requires that information from an equipment manufacturer even though the equipment manufacturer does not directly sell its products in the U.S. but supplies them to foreign vehicle manufacturers who sell their vehicles in the U.S. (see enclosed copy of NHTSA letter to Mr. K. Nakajima, dated January 6, 1972). Therefore, if your company has not already done so, please submit the information required by Part 566 to the Administrator of NHTSA within thirty days after receipt of this letter. No forms or prescribed format is required. A standard letter is sufficient.
